{"id":1080,"date":"2016-09-26T08:00:38","date_gmt":"2016-09-26T12:00:38","guid":{"rendered":"http:\/\/annelitwin.com\/?p=1080"},"modified":"2016-09-26T08:00:38","modified_gmt":"2016-09-26T12:00:38","slug":"stopping-harassment-in-the-legal-profession-the-aba-takes-a-stand","status":"publish","type":"post","link":"https:\/\/www.annelitwin.com\/blog\/blog-posts\/stopping-harassment-in-the-legal-profession-the-aba-takes-a-stand\/","title":{"rendered":"Stopping Harassment in the Legal Profession: The ABA Takes a Stand"},"content":{"rendered":"<p>\t\t\t\t<![CDATA[<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1077\" src=\"http:\/\/annelitwin.com\/wp-content\/uploads\/2016\/09\/Stopping-Harassment-in-the-Legal-Profession-300x226.jpg\" alt=\"Stopping Harassment in the Legal Profession\" width=\"300\" height=\"226\" srcset=\"https:\/\/www.annelitwin.com\/blog\/wp-content\/uploads\/2016\/09\/Stopping-Harassment-in-the-Legal-Profession-300x226.jpg 300w, https:\/\/www.annelitwin.com\/blog\/wp-content\/uploads\/2016\/09\/Stopping-Harassment-in-the-Legal-Profession-768x578.jpg 768w, https:\/\/www.annelitwin.com\/blog\/wp-content\/uploads\/2016\/09\/Stopping-Harassment-in-the-Legal-Profession-1024x770.jpg 1024w, https:\/\/www.annelitwin.com\/blog\/wp-content\/uploads\/2016\/09\/Stopping-Harassment-in-the-Legal-Profession.jpg 1280w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>The American Bar Association (ABA) recently passed national standards that prohibit harassment of opposing counsel, witnesses, coworkers, court personnel, and others in the course of practicing law. <a href=\"http:\/\/www.nytimes.com\/2016\/08\/10\/business\/dealbook\/aba-prohibits-sexual-harassment-joining-many-state-bars.html\">Elizabeth Olson of the <em>New York Times<\/em><\/a> reports that according to the new standards, \u201charassment includes sexual harassment and derogatory or demeaning verbal or physical conduct\u201d based on race, religion, sex, disability, age, sexual orientation, or marital or economic status.\nIn a <a href=\"http:\/\/www.nytimes.com\/2016\/08\/05\/business\/dealbook\/sexual-harassment-ban-is-on-the-abas-docket.html\">separate article<\/a>, Olson explains that harassment has long been intentionally used in the legal profession to intimidate or fluster opposing counsel and witnesses as well as to reinforce male-dominated attitudes in the legal profession.\u00a0 She reports that a recent ABA study found that \u201cstereotypical sexist remarks to female lawyers contribute to their underrepresentation in the legal field.\u201d The study also revealed these statistics:\n\n\n<ul>\n \t\n\n<li>Only 18 percent of partners at top law firms are women.<\/li>\n\n\n \t\n\n<li>In civil cases, men are three times more likely than women to appear as lead counsel and trial attorneys.<\/li>\n\n\n \t\n\n<li>In criminal law, men are four times more likely to appear as trial attorneys.<\/li>\n\n\n<\/ul>\n\n\nFemale lawyers explain that they usually try to ignore sexist and racist comments \u201cfor fear of imperiling their careers or being labeled less than a team player\u201d\u2014until they can\u2019t anymore and leave the profession.\u00a0 These are real concerns, and change will only happen if both male and female lawyers and judges hold offending attorneys accountable with the fines and penalties, such as disbarment, now possible when complaints are made and investigated.
